If you breach any of the conditions of this Terms of Use, your authorization to use this Site terminates automatically, and you must immediately destroy any downloaded or printed materials and disregard all content.

Authorship: The Site's full content is authored and owned by Frank Meronk, Jr., M.D. ("Dr. Meronk"), a retired ophthalmic plastic and reconstructive surgeon.

No medical advice: The Site should be viewed as a work of general consumer journalism that does not provide actionable or non-actionable specific medical advice. The Site is intended for use by consumers in online search of introductory information of interest pertaining to the field of eyelid plastic surgery. Content is not intended to replace or serve as substitute for medical or professional consultation or service from a practicing physician. Contained statements, observations, and opinions should not be taken as specific medical advice, recommendations, or treatment.

No physician-patient relationship: Dr. Meronk does not provide patient consultation or care. Use of this Site does not constitute the establishment of a physician-patient relationship between Dr. Meronk and a user. If you are experiencing any medical problem or are considering cosmetic or reconstructive surgery, you should base any and all decisions only on the judgment and advice of your personal physician who has examined you face-to-face and entered into a physician-patient relationship with you. Samples of before and after care instructions are abbreviated examples only and not those that were used by Dr. Meronk in his medical practice. In all medical matters before and after surgery, always follow only the recommendations of your treating physician.

In no event shall Dr. Meronk or its agents and employees be liable for any direct, indirect, incidental, special, exemplary, punitive, consequential or other damages whatsoever (including, but not limited to, liability for loss of use, data, or profits, or for personal injury of any sort), without regard to the form of any action, including but not limited to contract, negligence or other tortious actions, arising out of or in connection with this Site, any content on or accessed by use of the Site, or any copying, display or other use hereof.

Not for use by physicians: The Site may not be used by physicians as a medical reference. The Site is not intended nor of sufficient detail to teach other physicians about eyelid surgery.

Not for use by attorneys: Use of the Site by attorneys is strictly prohibited. Content of this Site is not intended for use in legal proceedings of any sort or to help establish a medicolegal standard of care. Contents of the Site should not be deemed sufficient in detail, accuracy, or timeliness to be cited as legal evidence either for or against the opinions, decisions, or actions of any physician, surgeon, or medical practice, including Dr. Meronk.

Photographs: Before-and-after photographs are presented for general illustrative purposes only. While typical, results shown may not be obtainable in all cases. Every patient's outcome will vary due to a range of variables, and not all patients will be pleased. Display of patient photographs does not constitute a warranty or prediction of outcome.

Any use of the Site's patient photos in copied or altered form by other doctors, operators of other web sites, members of the media, or any other third parties is in clear violation of the Site's copyright protections noted above and of federal patient privacy statutes and are subject to legal and ethical penalties. Violations will be aggressively reported to appropriate agencies.

Some commercial 'fashion' photos on the Site feature models and are used for purposes of conceptual demonstration or design. All before-and-after photos and surgical series photos are from actual patients of Dr. Frank Meronk and are designated as such.

Testimonials: Patient comments are from actual former patients of Dr. Meronk and are unsolicited. Display of testimonial statements does not constitute a warranty or prediction of outcome, and not all patients may feel the same way about their treatments or outcome. No consideration of any sort has been extended in return for such comments.

Denied Access: We reserve the right to block access to our website, form mail, or any other online feature based upon our sole discretion with or without cause.

Paid Products: In addition to all terms contained herein, the following applies to any paid access e-learning products:

-- All Sales are Final:(1) As intellectual property of the digital course is considered fully consumed upon first access by the user, there are no unused physicial products that can be "returned." (2) Because we provide an unusually extensive free preview, there is no initial trial period. Accordingly, we do not offer refunds.

-- No Ownership: Only temporary online access to e-learning products is offered. Once the term of enrollment has expired, a paid user will have no right of continued access. Payment of an access fee does not confer ownership of any product content, only temporary online access.

-- Service Interruption: We cannot be responsible for any loss of use or income due to interruption of service, including our hardware, software, server failure, and so on. These and similar problems beyond our control will be addressed as soon as possible. If persisting longer than 48 hours, we may extend the original term of service by a corresponsing period as our sole method of compensation.

-- Price Change: Prices charged for identical products may go up or down over time and/or during special promotions. Retroactive refunds are not offered.

-- License to Make One Paper Copy: An enrolled paid user is hereby granted the right to print one (1) paper copy of each page for personal reading use only, while digital copies (such as file download, PDF copy, or cut-and-paste, etc) of any content are prohibited. No further reproduction rights or other non-allowed uses by an enrolled paid user are granted by this license.

-- Payment Processing: Secure online credit card payment processing is provided by PayPal, a trusted third-party. We are not responsible for any problems or disputes between the buyer and the payment processor.

-- Distribution: Payment collection and distribution of paid content are provided by DJL under exclusive license from the author. Either this or the name BLEPH-101 will appear on your PayPal invoice or credit card statement.

Jurisdiction: These Terms of Use shall be governed by and construed in accordance with the laws of the United States of America, and, more particularly, the laws of the State of California. You expressly agree that exclusive jurisdiction for any dispute with Dr. Meronk, or in any way relating to your use of the Site, resides in the state and federal courts of Santa Barbara County, California, and you further agree and expressly consent to the exercise of personal jurisdiction in the state and federal courts of Santa Barbara County, California, in connection with any such dispute including any claim involving Dr. Meronk, its employees, and agents.

Subject to change: These Terms of Use is subject to change without prior notice. The user is thus responsible for reviewing the Terms of Use each time the Site is accessed. Repeated use of the Site signifies a user's full acceptance of the then-current Terms of Use.

Complete agreement: Except as expressly provided in a particular or specific notice on the Site, these Terms of Use constitute the entire agreement between you and Dr. Meronk with respect to use of the Site. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction as described in these Terms of Use, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.
